Playaway Products LLC - Terms of Sale

1. General Terms

These Terms of Sale (“Terms”) apply to all purchases made through Playaway Products LLC (“Playaway Products,” “we,” “our,” or “us”) for products, including but not limited to Playaway audiobook, Wonderbook, Launchpad, WhaZoodle, and associated products and services. By placing an order, you agree to be bound by these Terms. These Terms may be updated from time to time, and it is your responsibility to review them before making any purchase.

2. Orders and Acceptance

Orders are placed via our website, by email, by phone, or through our authorized distributors. All orders are subject to acceptance by Playaway Products. We reserve the right to refuse any order at our discretion, including but not limited to orders we believe may involve fraudulent activity or reselling.

3. Pricing and Payment

• Prices: All prices are quoted in U.S. dollars unless otherwise specified. For Canadian customers with an approved account, quotes may be provided in Canadian dollars. Prices do not include applicable taxes, duties, or shipping charges unless specified. Playaway Products reserves the right to change pricing at any time without prior notice; however, this will not affect orders already confirmed.
• Payment: Payment must be made in full via credit card, ACH, purchase order, or other authorized payment methods, unless otherwise agreed upon. Invoices are issued following shipment, and payments are due in accordance with the terms specified on the invoice.
• Taxes: You are responsible for any sales, use, or other applicable taxes associated with your purchase.

4. Shipping and Delivery

• Shipping Methods: Orders will be shipped via standard carriers unless otherwise specified. Shipping costs are calculated at checkout or invoiced separately.
• Delivery Time: Delivery times vary based on location and shipping method selected. Playaway Products will not be held liable for any delays in shipping caused by factors beyond our control.
• Risk of Loss: Title and risk of loss remain with Playaway Products until the products are delivered to the final destination, unless otherwise specified by the customer. If the customer specifies alternative shipping or delivery terms, risk of loss transfers to the customer when Playaway Products completes its delivery obligations by transferring the products to the carrier.

5. Returns and Refunds

• Eligibility: Products may be returned within 30 days of receipt, provided they are in their original packaging and condition, along with proof of purchase. Custom or special orders are non-returnable.
• Refunds: Once the returned product is received and inspected, refunds will be processed within 7-10 business days. Shipping charges are non-refundable, and return shipping costs are your responsibility unless the return is due to our error.
• Defective Products: If you receive a defective product, Playaway Products will provide a replacement or full refund at our discretion.

6. Product Warranty

Playaway offers a limited warranty on all products sold. The warranty period varies by product and is specified on the product packaging or in accompanying materials. The warranty covers defects in materials and workmanship under normal use conditions. This warranty does not cover damage caused by misuse, accidents, or unauthorized modifications.

7. Limitation of Liability

To the fullest extent permitted by law, Playaway Products shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the sale or use of our products. Our liability is limited to the purchase price of the products.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in New York County, New York.

9. Changes to Terms of Sale

Playaway Products reserves the right to amend these Terms at any time. Any changes will be effective upon posting to our website or otherwise notifying customers. Continued use of our products after any such changes indicates your acceptance of the revised Terms.
